さて問題は､なぜ宇賀説があのようになったのかである｡法律案審議録の中には､立案担当部局が提出する説明資料（通常｢内閣法制局説明資料｣などと題される）が､本件の場合（他の法律の場合と比べて）あまり含まれていなかった｡一つだけそれらしき文書があるのだが､日付が記載されておらず､どの時点のものか不明であるが､以下のように､途中段階の条文に沿った説明がなされている｡
